Terms of Service

These Terms of Service (the “Terms”) govern your use of Topiti, a bilingual AI tutoring service for children offered by Daniel Alejandro Nader de Leon, a Mexican Persona Fisica con Actividad Empresarial(PFAE) (“Topiti”, “we”, “us”).

1. Acceptance
By creating an account, paying for a subscription, or otherwise using Topiti, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the service.
These Terms form a binding agreement between you (the parent or legal guardian) and Topiti. The child does not contract with us; the parent does, on the child’s behalf.
2. Eligibility
The parent or legal guardian creating the account must be at least 18 years old. The child using Topiti may be of any age in our supported range as long as the parent provides verifiable consent and supervises the child’s use according to applicable law.
You represent that all information you give us during signup (your age, email, billing details, the child’s age) is accurate.
3. License to use the service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocablelicense to access and use Topiti for your household’s personal, non-commercial educational use. We may revoke this license if you violate these Terms.
4. Prohibited uses
You agree NOT to:
- Abuse the service or any user (including the mascot character).
- Scrape, crawl, mass-download, or otherwise extract content or data from Topiti without our written permission.
- Attempt to jailbreak, manipulate, or bypass safety filters in the AI models powering Topiti.
- Share authentication tokens, family invite codes, or kid access codes with unauthorized people.
- Reverse-engineer, decompile, or attempt to derive the source code of any part of the service except as expressly allowed by law.
- Use the service to harass any person, including children.
- Use the service in violation of applicable law (including child protection laws).
5. Ownership of content
The child retains ownershipof the drawings, voice recordings, chat messages, and other content the child creates inside Topiti. The parent, as the child’s legal guardian, exercises those rights on the child’s behalf.
You grant us a non-exclusive, royalty-free, worldwide license to host, transmit, display, and process that content solely as necessary to provide the service to you. We do not use child content to train external AI models without explicit, separate, opt-in consent from the parent.
Topiti, the mascot, the brand, the curriculum crosswalks, the software, and all related intellectual property remain ours.
6. Subscription, billing, refunds
- Price: US$4.99 per month per family. The family plan covers up to 6 children.
- Free trial: 14 days, no credit card required to start. At the end of the trial, the service stops unless the parent has added a payment method.
- Auto-renewal: the subscription renews automatically each month at the then-current price. We will email a reminder before any price change takes effect.
- Cancellation: the parent may cancel at any time from the parent dashboard. Cancellation takes effect at the end of the current billing period; the family keeps access until then.
- Refunds: Topiti offers a pro-rated refund of the first month if requested in writing to legal@topiti.xyz within 30 days of the first charge. Subsequent months are non-refundable except as required by applicable consumer protection law.
- Payment processor:Stripe processes all payments. We do not store card numbers. You agree to Stripe’s terms in addition to these.
All payment surfaces live in the parent dashboard. The child never sees pricing and cannot initiate a purchase.
7. Termination
By you: the parent may delete the account at any time from the parent dashboard. Deletion follows the schedule described in our Privacy Policy (30-day grace period, then hard purge).
By us: we may suspend or terminate the account if we reasonably believe you have violated these Terms, with at least seven (7) days’ written notice by email to the registered parent address. We may suspend the account immediately and without prior noticeif we reasonably believe a child’s safety is at risk, in which case we will notify you promptly after the suspension and explain the basis.
On termination, the license in Section 3 ends. Sections that by their nature should survive (ownership, limitations, governing law) survive termination.
8. Limited warranties
Topiti is provided “as is” and “as available”. We make no medical, therapeutic, diagnostic, or educational guarantees: in particular, we do not promise that any child will achieve any particular learning outcome, score, or developmental milestone. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, our warranties are limited to the minimum required by law.
9. Limitation of liability
To the maximum extent permitted by law, Topiti and its operator will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to the service. Our aggregate liability for any claim arising out of or related to the service is capped at the fees you paid us in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited under applicable law (for example, gross negligence, willful misconduct, or harm to a person caused by our negligence to the extent such limitation is unenforceable).
10. Governing law and dispute resolution
For users residing in Mexico: these Terms are governed by the laws of the United Mexican States. The competent courts of Mexico City (Ciudad de Mexico) have exclusive jurisdiction over any dispute, expressly waiving any other jurisdiction that may correspond by reason of present or future domicile.
For users residing in the United States: these Terms are governed by the laws of the State of California, without regard to conflict of laws principles. The state and federal courts located in San Francisco County, California have exclusive jurisdiction over any dispute, except that either party may seek injunctive relief in any court of competent jurisdiction.
Nothing in this Section deprives a consumer of any non-waivable right to file a claim in their place of residence under applicable consumer protection law.
11. Changes to these Terms
When we make a material change, we will email registered parents at least thirty (30) daysbefore the change takes effect and post the updated Terms with a new “last updated” date. Continued use after the change indicates acceptance. A parent who does not accept the change may cancel and delete the account before the change takes effect; in that case the old Terms apply to the remainder of the billing period.
